The Lincoln man who shot and killed another man in his apartment earlier this week during a physical altercation has been charged with first-degree murder.
The Lancaster County Attorney's Office on Thursday charged 53-year-old Jacob Mulloy with first-degree murder and use of a firearm to commit a felony, according to court documents.
Police Chief Michon Morrow said that Mulloy called 911 shortly after the shooting occurred and turned himself in without incident when officers arrived.
At a press conference Wednesday morning, Morrow said the two men were having a dispute prior to the shooting about Armstrong previously entering Mulloy's residence without permission. The two had known each other for several years before the incident.
According to the probable cause affidavit, Armstrong was disgruntled about the accusations Mulloy was making about him entering Mulloy's apartment without permission and that he was telling others.
Armstrong pushed Mulloy in the chest, which caused him to fall backward. Armstrong raised a fist in a "punching-like manner" and threatened Mulloy, the affidavit says.
Mulloy drew his firearm from his waist and fired one round, hitting Armstrong in the head.
Morrow said that Mulloy performed CPR on Armstrong before first responders arrived.
Police say Armstrong was not armed and believe Mulloy's response was beyond self-defense. Mulloy was not injured in the scuffle.
Judge Timothy Phillips set Mulloy's percentage bond at $1 million, meaning he would have to pay $100,000 to be released.
He is being held at the Lancaster County jail.
This was the second homicide in Lincoln this year.
Three security guards working at the bar attempted to intervene when Little or someone else in his group grabbed a baton from one of the security guards. They went outside, and a scuffle ensued as they tried to get it back.
A 24-year-old security guard then fired four shots, hitting Little in the arm and upper chest, police say. He was taken to a local hospital, where he died from his injuries.
