An issue over attorney representation will delay a potential foreclosure sale of Abbott Sports Complex scheduled for next week.
A Lancaster County District judge Wednesday disqualified Lincoln firm Woods & Aitken LLP from representing the Ethel S. Abbott Charitable Foundation in its efforts to foreclose on the sports complex.
According to court documents, Woods & Aitken attorneys had previously represented the Lincoln Sports Foundation, which runs the facility at 7600 N. 70th St., in matters that were "substantially related" to the current issue, and the Lincoln Sports Foundation did not provide written consent for the attorneys to now represent the Abbott Foundation.
Because of the ruling and the Abbott Foundation's need to hire new attorneys, the judge indefinitely postponed both the foreclosure sale scheduled for Dec. 1 and a hearing on the Sports Foundation's request for a temporary injunction to postpone the sale.

The Abbott Foundation in September foreclosed on a mortgage it holds on the 23-year-old complex after the Sports Foundation blocked an attempt to sell the complex to a local developer.
The Sports Foundation contends in its lawsuit seeking to block the foreclosure sale that it agreed to take on additional debt for a tennis complex because of promises from the Abbott Foundation that it would not have to make payments on the debt.
